Article 2 — Scope
These terms and conditions of sale apply to any order placed with bernée by a private or professional client, for the purchase of a light, a decorative object or a bespoke creation presented on the bernee.fr website. Placing an order implies unreserved acceptance of these terms.
Article 3 — Products
bernée creations are one-of-a-kind pieces, shaped by hand from upcycled maritime fenders. Each creation is numbered and comes with a certificate of authenticity. Slight variations in material, colour or finish may exist from one piece to another: these are part of the unique character of each creation and do not constitute a defect.
Article 4 — Prices
Prices shown on the site are in euros, all taxes included. VAT not applicable (art. 293 B of the French General Tax Code). Shipping is free within mainland France. For any other destination, any shipping costs are communicated before payment, in the quotation sent by bernée.
Article 5 — Ordering
As the site does not currently offer online payment, orders are placed as follows:
- you choose a creation on the site and get in touch via the contact form, specifying the piece you are interested in;
- bernée replies with a quotation detailing the price of the creation and the estimated timeframe;
- the order is confirmed upon receipt of your agreement and payment;
- the creation is dispatched once payment has been received.
Article 6 — Payment
Payment is made by bank transfer, using the details provided by bernée once the quotation has been accepted. The order is considered confirmed upon receipt of the transfer.
Article 7 — Delivery
Creations are dispatched to the address given at the time of ordering. Shipping is free within mainland France. Timeframes are given in the quotation and may vary depending on the destination and the size of the creation. bernée cannot be held responsible for delays attributable to the carrier.
Article 8 — Right of withdrawal
In accordance with articles L221-18 et seq. of the French Consumer Code, private clients have 14 days from receipt of the creation to exercise their right of withdrawal, without having to give a reason or pay a penalty, other than return shipping costs.
In accordance with article L221-28 of the French Consumer Code, this right of withdrawal does not apply to bespoke creations, that is, pieces designed or personalised specifically to the client’s requirements. Pieces presented in the site catalogue, even though unique and numbered, do not fall under this exception and remain subject to the right of withdrawal.
Article 9 — Legal guarantees
bernée creations benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (articles 1641 et seq. of the French Civil Code).
Article 10 — Complaints and mediation
For any complaint, the client may contact bernée using the details given in article 1.

Article 11 — Intellectual property
The creations, photographs, texts and graphic elements on the site are protected by intellectual property law. See the legal notice for full terms of use.
Article 12 — Governing law
These terms and conditions of sale are governed by French law. In the event of a dispute, and failing an amicable resolution, the French courts shall have sole jurisdiction.
